Yuvraj Singh slams real estate firm for delayed possession & breaching privacy

Yuvraj Singh, a retired Indian cricketer, has issued two distinct legal notifications to two real estate companies based in Delhi. These notifications were sent in order to activate arbitration clauses due to the alleged infringement of his privacy rights during the promotion of construction projects, as well as the delayed handover of a residential unit in the national capital.

The law firm Rizwan Law Associates, based in Delhi, has sent a legal notice on behalf of the cricketer, seeking appropriate damages for the delay in completing the Project and issuing the Letter of Possession without any valid cause or extension in the timeline.

The notice also mentioned, "Delivery of proper quality, standard, class and grade of the Apartment to My Client who was promised a premium quality Apartment and has been offered an extremely inferior quality Apartment."

The cricketer reserved a residence in 2020 at Hauz Khas, New Delhi in one of the real estate company's projects, as stated in the notification.

M/s Brilliant Etoile Private Limited and M/s Uppal Housing Private Limited have been identified as the parties involved in a legal notice concerning the delayed handover of the residential units.

Brilliant Etoile Private Limited received the cricketer's second notice exclusively, which addressed the violation of his privacy rights.

The second notice described, “That this dispute principally concerns with the violation of Intellectual Property Rights with respect to the Personality Rights and misuse of Brand Value of the Celebrity i.e., My Client in contravention to the terms of the Memorandum of Understanding dated 24.11.2020, however, My Client reserves the right to add the detailed instances and elaborate in further specificity in the Statement of Claim." 

In accordance with the Memorandum of Understanding (MoU), the cricketer had the responsibility to promote and endorse the project. The MoU concluded on November 23, 2023. The individual is upset by the alleged continuous commercial use of the services he provided, which includes the utilization of his photos on billboards, project sites, social media posts, and articles, despite the expiration of the MoU, as mentioned in the notice.

The ex-India all-rounder stated that the purported ongoing utilization of his likeness and that of others was a clear infringement of his Copyright, Personality Rights, and Right to Publicity as outlined in the laws and safeguarded as his Intellectual Property Rights.
