UP RERA intends developers to sell units based on Carpet Area

The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) directed the developers of housing projects in the state to sell their real estate units or apartments as per the carpet area only.

In accordance with the RERA Act 2016, while registering the project on the portal, promoters and developers has to mention the number of units or apartments and their types along with the floor, balcony, terrace and area of other spaces. Within this, they have to mention the Carpet Area – actual area of floor space among internal walls.

According to the provisions of RERA Act, buying and selling of apartments and units is legal only on the basis of carpet area.

A Stataement from UP RERA states, “A model agreement for sale has been provided on the UP RERA portal for an agreement for sale between promoter and an allottee. And this model agreement for sale is based on the carpet area. Within this way, the basis of 'Super Area' selling apartments or units is differing to the provisions of the RERA Act”.

On speaking to this, Sanjay Bhoosreddy, Chairman, RERA, Uttar Pradesh says, "There is no abbreviation or definition of Super Area in the RERA Act. It is indeed necessary for allottees to consider Carpet Area as the actual area of the unit or apartment and pay the promoter according to this area,”

Further he added "Hence promoters must ensure the sale of units according to the Carpet Area only.
