No restrictions on executing sale deeds in finished projects, says UP RERA

The U.P. RERA clarified on Tuesday that there are no limitations on carrying out sale deeds in favor of allottees in different projects within the Sushant Golf High-Tech Township by Ansal API, as long as completion certificates have been granted.

The developer has acquired certificates of completion for three developments: Santushti Enclave-I (Block-A, B-1, and B-2), Paradise Crystal (Block A, B, E, and F), and Celebrity Garden (Block/Tower No. 08, 09, 11, and 110 flats of Blocks/Tower F, G, and H) prior to the inception of the RERA in 2016.

The promoter is authorized to carry out registered sale deeds in the names of the allottees of these projects that have received completion certificates. 

 

The UP Real Estate Regulatory Authority (RERA) provided this clarification following a request from the developer and the buyers of specific projects. It highlighted that once a project is finished, buyers should be able to acquire ownership of their properties through properly registered sale deeds. Nonetheless, RERA stated that the developer must guarantee that there are no conflicts concerning ownership or title of the project's land or units prior to finalizing the sale deeds.

It should be highlighted that the RERA provided this clarification regarding its directive dated June 26, 2023, concerning the prohibition on the sale of incomplete projects within the Sushant Golf City High-Tech Township of Ansal API in the state capital.

Furthermore, the RERA has mandated that the developer must use the funds obtained from these registrations exclusively for settling payments to buyers in response to the recovery challans issued by the regulatory body.
