MahaRERA circulates new rules to safeguard interest of Homebuyers

Recently, MahaRERA was in news for suspending registrations of over 20,000 real estate agents in Maharashtra after they failed to comply with the mandatory rule of appearing for competency certification examination.

In last few back back, MahaRERA has issued around half a dozen regulatory orders to safeguard the interests of homebuyers in Maharashtra. These are related to parking space allotment, senior citizen homes, delivery date for amenities, quality of construction among others. 

In April 2024, MahaRERA mandated real estate developers to include clear information about parking spaces in sale agreements and provide allotment letters to prevent disputes. This was in response to complaints from homebuyers about issues like obstructed parking spaces and inadequate maneuvering space. Developers must now include detailed dimensions of parking spaces in both documents.

MahaRERA has set new guidelines for housing projects for senior citizens, making it the first housing regulatory authority in India to do so. The guidelines cover design, accessibility, mobility, bathrooms, green principles, and safety features. Developers must include these provisions in the Agreement for Sale and other documents. Senior citizen housing projects must follow these model guidelines.

Upon receiving numerous complaints from homebuyers regarding delays in providing amenities or discrepancies between promised and actual facilities, MahaRERA implemented a new requirement in April. Developers are now obligated to specify information such as the delivery date, size, and location of amenities to guarantee that homebuyers receive what was initially promised to them.

MahaRERA released guidelines in April 2024 for the selection of third-party agencies to assess the quality of construction prior to the handover of properties to homebuyers. The regulatory authority has established a system for Third Party Quality Monitoring to ensure construction quality is maintained from the beginning. This system involves conducting quality audits at various stages of the construction process, including the final finishing stage before the properties are handed over to homebuyers.
