Anil Parab's close associate Sadanand Kadam accepts Bombay HC's order of demolition in Sai Resort

Anil Parab, a leader of Shiv Sena UBT and a member of the Maharashtra Legislative Council, was reportedly informed by his alleged close associate Sadanand Kadam on Friday that the "illegal" section of the Sai Resort in Dapoli would be demolished within a span of 10 days, as per the Bombay High Court.

Kadam, represented by advocate Saket Mone, conveyed to the High Court that he offered an unconditional apology for failing to adhere to the order issued on March 18. 

 

Mone mentioned that due to various challenges, the demolition of the second floor of the building is experiencing delays, resulting in a slight setback. Nevertheless, the demolition is expected to be finished within the next 10 days.

Kadam stated his intention to demolish the surplus and unauthorized section of the resort, contrary to the September 12, 2017 directive from the Sub-Divisional Officer, Dapoli Division, Dapoli, using his own funds.

The court approved Kadam's commitment and instructed him to remove the section above the permitted area by April 15, 2024. The High Court, on the other hand, extended the temporary relief until April 17 for a portion of the resort that does not breach the 2017 permission. Subsequently, on April 17, Kadam notified the High Court that he had fulfilled the commitment made to the Court.

Justice Madhav Jamdar, sitting alone on the bench, acknowledged his apology and scheduled the case for another hearing on June 11th. Kadam's plea challenging the 2023 demolition notice issued by the sub-divisional officer was approved by the order. It was claimed that the previous owner of the property in Dapoli had been given permission to build a ground plus one-floor structure on the land. However, Kadam allegedly constructed additional floors without obtaining the necessary permission.

It was further claimed that the complete scheme for the resort's construction was situated in the CRZ-III zone, designated as a no-development area, without obtaining the necessary approval from the relevant department or Ministry.

The Ministry of Environment, Forest and Climate Change lodged a complaint against Parab, Sai Resort, Sea Conch Resort, and others with the judicial magistrate in Dapoli for breaching the Environment (Protection) Act 1986. Consequently, the Enforcement Directorate (ED) initiated a money laundering investigation which led to the arrest of Kadam on March 10, 2023. Kadam was granted bail earlier this year in February.
