The House of Abhinandan Lodha (HoABL), a realty business firm founded by the younger brother of Abhishek Lodha has been asked to refrain from using the brand name "Lodha" in any way.
According to the statement, the two parties inked a new agreement in December 2023 due to non-compliance. It forbids the younger brother from going by names that sound like "Lodha."
The commercial intellectual protection suit filed by Macrotech in the Bombay High Court says, "The Lodha Group has spent considerable time, effort and money building its brand through advertisements and endorsements, and is renowned across India and abroad for the quality and scale of its developments”.
According to Macrotech's petition, the defendants are specifically forbidden from using the Lodha trademarks or any trademark that is confusingly similar in light of the 2017 agreement.
“The registration of the impugned marks by the defendant are ex-facie illegal, fraudulent, and of a nature that ought to shock the conscience of the court,” Macrotech said.
It claimed that in addition to making multiple false statements while submitting applications for or obtaining registration of the contested marks, the defendants had concealed important and pertinent information from the trademark register.
Regarding this, Lodha spokesperson says “Lodha's brand has been built with lots of investment and effort over 40 years. The company must protect its IPR and ensure that no other developer creates confusion about being similar to / same as our brand. Our shareholders include the world's most renowned investors and one of India's largest charitable entities - we are duty bound to protect our company's valuable rights.”
He replied that he had previously assisted Macrotech numerous times, even after the family settlement, including by lending Rs. 900 crore through the NBFC, providing personal and corporate guarantees, and even mortgaging his own apartment to generate money for the family.
