Be cautious & verify Legal status of Property before buying, says MahaRERA

The Maharashtra Real Estate Regulatory Authority (MahaRERA) has recently directed a real estate developer constructing a project near Mumbai to disclose all pending litigation details in the public domain. This decision aims to safeguard the interests of homebuyers by ensuring greater transparency.

In a project located in Thane, near Mumbai, the landowner filed a complaint with MahaRERA in September 2024, raising concerns about ownership rights and the developer’s failure to disclose pending litigation on the MahaRERA website.

According to the landowner, the developer concealed critical legal information and continued selling properties to unsuspecting buyers, putting their investments at risk.

During the hearing, MahaRERA clarified that issues related to land ownership do not fall under its jurisdiction, and therefore, it cannot adjudicate on such matters. The landowner informed the authority that he had approached the high court for arbitration and would pursue appropriate legal measures against the developer. He has requested that the matter be resolved to establish a clear title for the project.

In its order, MahaRERA directed the developer to upload the details of pending litigation in the designated column on the MahaRERA website within 15 days from the date of the order. Failure to comply will result in penal action against the developer.

Additionally, after reviewing the case, MahaRERA ruled out any violation of Section 4 by the developer, noting that the complaint was filed after the developer had already obtained MahaRERA registration for the project.
