The Allahabad High Court has directed the Noida Authority to initiate flat registrations at the Meghdutam housing project in Sector 50, bringing long-awaited relief to residents who paid in full but have been waiting years for property documents.
The interim order, issued on January 15 by a division bench of Justices Manoj Kumar Gupta and Anish Kumar Gupta, came in response to a petition from 19 residents.
The court instructed the Authority to register flats based on an occupancy certificate granted a decade ago, while simultaneously pursuing outstanding dues from TGB Infra Developers, the builder.
The court criticized the Noida Authority for its inaction in recovering the dues. It highlighted that Anil Kumar Saha, a director at TGB Infra, is associated with 39 other active real estate companies, presenting multiple avenues for recovering funds. While Saha is currently in jail, the other two directors are untraceable. His counsel argued that Saha is unable to clear the dues.
In its directive, the court stated, "We issue an interim mandamus directing the Noida Authority to execute tripartite sub-leases in favor of the petitioners, who have fully paid and occupy their flats based on the occupancy certificate issued by the Authority."
The Meghdutam project, consisting of 173 units on a 12,750 sqm plot, was allocated to TGB Infra in 2008. Initially, the outstanding dues amounted to Rs. 55.3 crore but were later reduced to Rs. 43.7 crore following a two-year zero-interest waiver under a government rehabilitation package.
However, TGB Infra did not avail of the scheme, leaving the dues unpaid. The court’s order marks a significant step towards resolving the long-standing property registration issue.
